Property Ownership & Building Restrictions

Molloy Island is 167 ha (413 acres) in area with 275 privately owned residential lots, typically between 1,600m2 and 2,100m2 in size.

Access to the island is via a barge that is owned and operated by the Molloy Island Homeowners Association (MIHOA).

Property owners must become members of the MIHOA and an annual levy is charged to each property which covers infrastructure and general running costs of the island. A First Mortgage is held by the MIHOA over every property.

To protect our natural environment and the resident wildlife, only property owners (not visitors) are able to bring dogs onto the island. There is no off lead dog exercise area on the island and cats are not allowed under any circumstances.

Properties on the island are zoned R10/15 and fall under the AMR Shire Local Planning Scheme. Molloy Island is one of a number of Special Control Areas where additional restrictions apply due to the sensitive natural environment. The objective of the Molloy Island Special Control Area (SCA2) is to protect the existing natural qualities and amenity of Molloy Island by strict control of all development. This includes a number of restrictions (for full details please refer to the Local Planning Scheme document):

  • The removal of any indigenous tree or clearing of indigenous undergrowth is prohibited, other than for approved fire hazard reduction measures (e.g. firebreaks, building protection zones, hazard separation zones) without the prior written approval of the local government.

  • Vegetation which is not indigenous to Molloy Island shall not be introduced, with the exception that domestic gardens within the immediate curtilage of a dwelling and as approved by the local government, may contain non-invasive non-indigenous species which, in the opinion of the local government does not adversely impact upon the integrity of the Island's indigenous vegetation.

  • Soil, earth, rock or gravel reasonably suspected of being infected with plant disease and/or invasive plant species must not be introduced.

Development on residential lots:

  • development is confined to a single dwelling and its incidental development;

  • building is prohibited within 15 metres of a public right-of-way and within 5 metres of a side boundary;

  • subdivision of lots will not be supported by the local government;

  • boundary fences are prohibited except for the construction of a post and wire fence around a rear courtyard having an area no greater than 10% of the lot and the fence is not visible from any road;

  • development is prohibited unless the on-site septic effluent disposal capacity is sufficient to support the proposed development, and onsite effluent disposal arrangements are provided to the satisfaction of the local government.

Essential services are limited by the scheme and are as follows:

  • underground mains power supply only. Private petrol and diesel driven independent electricity generators, other than for emergency purposes, are prohibited;

  • renewable energy systems to the satisfaction of the local government;

  • each new dwelling unit shall be served by its own water storage tank with a capacity of not less than 90,000 litres.

Any building applications submitted to the shire are also submitted to the MIHOA committee who will assess the application based on a number of criteria.
